1. Introduction
Welcome to CollectiveAccessBridge ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at collectiveaccessbridge.top (the "Service") operated by CollectiveAccessBridge.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
CollectiveAccessBridge offers upscale yacht charter services including but not limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
All services are subject to availability and weather conditions. We reserve the right to modify or terminate services at our discretion.
3. Booking and Reservations
3.1 Booking Process
For reserving a charter, please:
- Confirm you are at least 18 years old
- Ensure all information provided is accurate and complete
- Pay the required deposit as indicated in your booking confirmation
- Concur with these Terms & Conditions
3.2 Confirmation
Confirmation of your booking occurs upon receipt of payment and our written acknowledgment. We hold the discretion to decline service to anyone.
3.3 Availability
Charter availability is subject to vessel readiness and appropriate weather conditions. Every effort will be made to fulfill your desired charter dates and timings.
4. Payment Terms
4.1 Pricing
All charges are stated in € and cover applicable taxes unless stated otherwise. Pricing is subject to change without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the full cost of the charter is due at the time of booking
- Remaining Balance: Due 48 hours prior to the charter departure
- Any additional fees: Due upon the conclusion of the charter
4.3 Payment Methods
We accept various forms of payment, including major credit cards, bank wire transfers, and certified cheques. Our secure, encrypted systems handle all payment processing.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- For cancellations made over 72 hours before departure: Full refund minus any processing charges
- For cancellations made between 24 to 72 hours before departure: 50% refund
- For cancellations made less than 24 hours before departure: No refund
5.2 Weather-Related Cancellations
If our captain deems weather conditions as unsafe, we will propose to:
- Reschedule your charter to another available date at no additional cost
- Issue a full refund should rescheduling not be an option
5.3 Mechanical Issues
In the case of mechanical issues with the assigned vessel, we will attempt to provide an appropriate alternative. If no substitute is possible, a complete refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are required to:
- Comply with all directions from the crew
- Wear any provided safety equipment as necessary
- Reveal any medical conditions that could affect their safety
- Stay within designated passenger areas on the vessel
6.2 Prohibited Items
It is prohibited to bring onboard the following items:
- Glass containers
- Illegal substances
- Weapons of any kind
- Pets, except if previously approved
6.3 Conduct
Passengers must behave in a courteous and respectful manner. Should passenger's actions pose a danger to safety or cause disruption, we may terminate the charter prematurely without any refund.
7. Liability and Insurance
7.1 Our Liability
Our liability is limited to the amount paid for the charter and does not include:
- Injury caused by a passenger's negligence
- Damage or loss of personal effects
- Indirect or consequential damages
- Delays due to weather or events outside of our control
7.2 Insurance Coverage
We carry comprehensive marine insurance for our fleet and operations. Personal travel and property insurance is the passenger's responsibility.
7.3 Assumption of Risk
By engaging in our charter services, you accept the inherent risks associated with maritime activities and agree to take responsibility for your safety and security.
8. Modifications and Itinerary Changes
We may alter itineraries, paths, or timetables based on meteorological conditions, safety needs, or operational demands. We will make an effort to offer a comparable alternative experience wherever feasible.
9. Force Majeure
We are not accountable for delays, cancellations, or changes caused by events beyond our control, such as but not limited to:
- Extreme weather
- Natural catastrophes
- Governmental rules
- Port closures
- Vessel failures
10. Privacy and Data Protection
Your personal data is managed according to our Privacy Policy. Utilizing our services indicates agreement to our data collection and use as outlined in the Privacy Policy.
11. Intellectual Property
All material on our website, such as text, images, and logos, is protected by copyright and trademark laws. Unauthorized reproduction, distribution, or derivative works are prohibited without our express consent.
12. Governing Law
These Terms are subject to the laws of Monaco. Any disputes will be resolved in the courts located in Monte Carlo, Monaco.
13. Changes to Terms
We may revise these Terms at our discretion. Updates will be posted on our website with the revision date noted. Your continued use of our services indicates acceptance of the new terms.
